Good news for the owners of Empuriabrava! &#160; The Board of Directors of the APE, together with the lawyers, had many meetings in the past days and weeks with politicians, [...]</p><p>The post <a href="http://www.different2.com/news/good-news-owners-empuriabrava/">Good news for the owners of Empuriabrava!</a> appeared first on <a href="http://www.different2.com">Different2</a>.</p>]]></description> <content:encoded><![CDATA[<p>This excellent news was sent to all members of  APE, regarding the Canals of Empuriabrava.</p><p>&nbsp;</p><p>Empuriabrava, March 20, 2013</p><p>Dear members of the APE!</p><p>Good news for the owners of Empuriabrava!</p><p>&nbsp;</p><p>The Board of Directors of the APE, together with the lawyers, had many</p><p>meetings in the past days and weeks with politicians, the Ministry, European</p><p>Parliament etc&#8230;</p><p>&nbsp;</p><p>&nbsp;</p><p>&nbsp;</p><p>Thanks to these efforts of the APE, the party PP (Partido Popular) presented</p><p>yesterday in the Senate a modification proposal for the draft law changing</p><p>the coastal law regarding the &#8220;urbanizaciones marítimo-terrestres&#8221; and their</p><p>owners.</p><p>&nbsp;</p><p>&nbsp;</p><p>&nbsp;</p><p>According to this proposal (in simple terms):</p><p>&nbsp;</p><p>&nbsp;</p><p>&nbsp;</p><p>- the cuts on the plots will be excluded from the state property (dominio</p><p>público), not just those which are covered, the boat garages, (the previous</p><p>draft law referred to this), but also the cuts which are not covered.</p><p>Therefore all cuts on the plots (retranqueos) remain private property.</p><p>&nbsp;</p><p>&nbsp;</p><p>&nbsp;</p><p>- the private ports and Escritura moorings will be excluded from the state</p><p>property; these are private properties which were artificially flooded and</p><p>which are adjacent to the channels, and are determined as a collective and</p><p>private boat parking place. Therefore, the private ports and Escritura</p><p>moorings will remain private property.</p><p>&nbsp;</p><p>&nbsp;</p><p>&nbsp;</p><p>- it will be accepted, that the owners of property alongside the channel</p><p>(amarres vinculados) have the right to use the moorings alongside the</p><p>property and that this right is connected to the property and will only be</p><p>transferred together.
